DUI Convictions

The following are convictions made for driving under the influence with a blood-alcohol content of 0.08 percent or higher or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the following: drug/alcohol evaluations, Victim Impact Panel, Attitudinal Dynamics of Driving, Level II education and therapy, Alive at 25, inpatient and/ or outpatient treatment or therapy, and must submit to random tests for drugs and alcohol use. Suspended imposition of additional jail sentence (in parentheses) is conditional upon completing probation successfully and are awarded if all other requirements of the sentence are completed within one year. Dollar amounts are fines and court costs defendants were ordered to pay.

A deferred judgment is not a conviction; it is a sentence typically put off (deferred) for a specific period of time, typically a year. If the defendant complies with each of the conditions of the deferred sentence within the allotted time period, the defendant’s record is cleared of this charge.

TUESDAY, OCT. 2

cortez colorado Escamilla Gildardo Herrera, 29, of Snyder, Colo. Driver’s License – Evasion of Interlock Device. Fifteen days in jail, $459.50. Additional deferred sentence: 1 year unsupervised probation.

DWAI Convictions

The following are convictions for driving while ability impaired with a blood alcohol content between 0.05 percent and 0.08 percent or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the classes or programs listed above in the DUI category; additional listed conditions also apply

WEDNESDAY, SEPT. 26

cortez colorado Brien O’Neill Kelly, 42, of Dolores. (Thirty days in jail suspended imposition), 12 months unsupervised probation, $815.50, community service 24 hours.

TUESDAY, OCT. 2

cortez colorado Stephen Fran Wagner, 56, of LaPine, Ore. (Thirty days in jail suspended imposition), deferred sentence: 12 months unsupervised probation, $736.50, community service 24 hours. Weapon confiscated in the traffic stop is to be returned to the defendant by way of his counsel.

Domestic Violence

The following cases of domestic violence require those convicted to attend and complete one or more of these additional classes or programs in addition to jail time, probation, fines and community service: domestic violence evaluation, substance abuse treatment and testing, inpatient treatment and anger management.

cortez colorado Joshua K. Begay, 24, of Aneth, Utah. Driving Without a Driver’s License, $267.50.

cortez colorado Chris Brian Wallux, 33, of Towaoc. Driving Without a Driver’s License, $503.50.

cortez colorado Crystal R. Johnson, 29, of Towaoc. Driving Under Restraint; Failure to Display Proof of Insurance. Deferred sentence: 12 months probation, $769.50. Must obtain driver’s license within the next 12 months and provide proof to the court.

cortez colorado William S. Hooker, 50, of Cortez. Commercial Vehicle Safety Violation; Parking on Roadway. $165.50.

cortez colorado Michael S. Costen, 30, of Mancos. Littering – first offense. $276. Plea in this case will not be grounds to revoke deferred sentence in case #11T699.

cortez colorado Maria Begay, 60, of Chinle, Ariz. Driving Without Insurance. Deferred sentence of 12 months unsupervised probation, $120.50.

cortez colorado Jenathan J. Begaye, 29, of Aneth, Utah. Leaving the Scene of an Accident – Unattended Vehicle. $335.50, Restitution is open for 90 days.
